Discourses of rank in Shakespeares Othello - Free Essay Example

Foucault defined discourse as the ways of constituting knowledge, attached to the social practices, forms of subjectivity as well as the power relations that exist in the knowledge and relations between them. They circulate the nature of the body, unconscious and conscious mind as well as the emotional life of the subjects. Discourse provides the difference between the words pronounced by a person and the actions portrayed by the person.   Discourse translates to the way a person puts his or her ideas into practice and communicates more about the conduct of other people.   This paper seeks to discuss the different discourses of rank voiced by Iago/Roderigo and Othello. It will provide a critical analysis that evaluates the discourses as either good or bad. Throughout the play, Shakespeare demonstrates a discourse of rank using characters like lago and Roderigo. In the opening scene, lago identified Othello as â€Å"the thick-lips† and continue to identify this character as â€Å"the health of black Othello.† These and other comments identify Othello as a black African whose origin can be traced in the sub-Saharan region. Lago’s comment in the first scene of this play is accepted as the actions of racism that exist in the current generation. Despite the failure of England to participate in the slave trade in 1604, Shakespeare developed some knowledge about the people of the African heritage and managed to rank their capabilities through the play. Moreover, Shakespeare used Roderigo to express his discourse of rank through the description of the Moor. Roderigo identified the Moor as â€Å"lascivious† while lago responded as with the comment of the â€Å"devil will make a grandsire of you.†Ã‚   Lago intended to arouse Brabantio’s wrath using the verbal images of his daughter copulating unnaturally with a bestial creature, a demonic figure of vice and depravity. In addition, lago perpetuated the myth of Moors having promiscuous sexual appetites. He identified lago as a black and an old ram that probably seduced Emilia. His description demonstrates the envy of powers that lago imagines to be greater than his powers.   These descriptions by the two characters showed hatred to the Moors that translate to the actual deeds of the Lago and Roderigo.   The descriptions contradict Othello’s argument on the hatred showed on Lago and Roderigo to the Moor. Othello argues eloquently that the hatred is not a g enuine reaction. In the middle of the temptation scene, Othello seems to believe in the words said by lago and Roderigo. He went ahead to express the same kind of hatred to other characters of the scene like the Desdemona. He wanted to put her into messes and tear her to pieces.   Therefore, Othello’s words appear to contradict the way he interacted with other people showing the discourse of rank in the entire scene. From the above description, one can conclude that Shakespeare developed the capacity to exploit the full complexity of the discourse of rank with an expectation of showing the way the white villain opposed a black man of heroic proportion.   Although the predominant typology of white over black is only temporarily subverted in fits and starts in the play, the subversion is itself an incredible artistic triumph. Therefore, the discourse is used to express the confrontation that existed between the black and white that continued to express the current prejudices, fear, and hopes.

Poem Response Essay - 752 Words

In just one paper, I am going to go from two inspirational poems, to a more depressing one. The inspirational poem I will be responding to is â€Å"The Tyger†, written by William Blake. This piece is by far one of my favorite poems read. I read it often just to remind me not to wimp around with my lifting and my getting bigger, just like the song by Survivor, â€Å"Eye of the Tiger†, does for me. It keeps in mind what it’s going to take to do this. The second piece of inspiration I like is, â€Å"I will put Chaos into fourteen lines†, by Edna St. Vincent Millay. On a depressing side of things, I am then moving on to a more disheartening type of poem. The author tries to describe how to attempt to hold chaos back. Through this poem, she describes chaos as a male type of thing by constantly referring to chaos using he, his, and him. She shows chaos’s many features, such as its â€Å"adroit designs†, amorphous shapes, and it’s arrogance. I don’t like how the author tries to contain chaos, because really it could never happen. Chaos is something that once released or started, is a very hard thing to get put down or stopped. I know that this is under the title of the poem, that she is putting chaos into the fourteen lines, but I still don’t like how it’s written. I think the poem should be more uncontrolled, and having the chaos breaking out of the poem in the e nd. They are often glorified and portrayed to be patriots for their country, which is frequently conveyed through poetry. I disagree with this view, and the following three poems written by past soldiers support my view on war. Siegfried Sassoon is a renowned World War 1 poet who was in service from 1914 to 1917, when he then took a stand against the conduct of war. When Sassoon first began writing his poetry, he did so with an air of romance and sweetness. After becoming horrified by the reality of war, his writing then became†¦show more content†¦He believes it is dark, evil and depressing, and while the soldiers are sent to hell, some remain there whilst others bring pieces of it back home with them. He wants those in the crowd to pray they’ll never know what he and many others have lived, and died, through. Sgt. James Lenihan served in the Second World War in the 104th infantry division, where he toured Europe fighting. He was wounded in action and received a purple heart, though he never spoke about his experiences in the war with his family. After his passing in 2007, his family found a poem that he wrote where he describes his experience in killing a man in action. The poem is titled Murder: Most Foul, which is borrowed from Shakespeare’s Hamlet. It has six 4-lined stanzas and a final 5-lined stanza, with each having different rhyming patterns. The first two stanzas have the pattern ABCDEBCD, stanzas three through six have the pattern ABCB, and the 5-line stanza has the pattern ABCDB. The poem utilizes multiple techniques including repetition, rhyme, imagery and metaphor. Lenihan uses the terms ‘surprise’ and ‘strangest’ to convey the rarity and unusualness of what was happening. He began to cry for he killed fellow man in cold blood. The equal protection clause provides equal rights to vote to be provided. (a) The school assignment is based on individualized racial classifications to achieve diversity or avoid racial isolation through student assignment. (b) The fundamental right of equality is involved in this case. (c) If this case was to be heard by the Supreme Court it would have applied the affirmative test. In Bush v Gore the court found the recount to violate the equal protection clause because different standards were adopted by the states for counting. Activity 25: On May 17, 1999, the case of Saenz v. Roe 119S. Ct. 1518 (1999) was decided and a new chapter began in the Constitutional law. In this case, the court condemned the requirement of residency of 1 year duration, provided by the California welfare statute. The decision in this case was based on the immunities or privileges clause of the 14th amendment of the Constitution. The supreme court held that although the word travel does not exist in the constitution, but it is a constitutional right and held that the new residents, who want to become permanent residents had the right to travel and it included the right for equal treatment with the other citizens of that state. Substantive due process provides a limitation on the kinds of laws, which can be enacted by the government and prohibits it from making laws, which interfere with the right to life, liberty and property. While procedural due process provides a limitation on those procedures, which are adopted by the government while depriving a person of life, liberty and property, means prohibited the government from taking away such right. The difference between the taking and forfeiture is that the government may take away the assets of the criminal, even if an arrest or conviction may not have taken place. In forfeiture, the government takes away the property because of the fact that property itself was involved in an illegal act and is directed against the property and not the person possessing that property. The contract clause contains a prohibition on the state from making any laws, which may interfere with the fulfillment of the obligations of the contract. However, this part of the constitution is not absolute and in certain circumstances, the police powers of a state are used by the state for enacting such laws, which may interfere with the fulfillment of contractual obligations. Thus, the states police powers may affect the contract clause. Activity 26: Practical Problem: Appraisers are also called property valuers. Everyone has e right to receive a fair market value for his property. The term, market value refers to the most feasible price, which a seller should get for his property, if it is brought in an open market with all the conditions required for a fair sale and with the purchaser and seller acting wisely and honestly. This value is determined by the appraisers (Murphy, 2010). The appraiser should be highly qualified and experienced. Either a real estate professional, who is experienced in the real estate business and has essentially acquired a certificate or license in this field can be hired for the purpose in the given case. He must have undergone an appraisal methodology (Reuters, 2014). Or any other appraiser, who fits into the standards specified in Uniform Standards of Professional Appraisal Practiceand qualifies the licensing criteria defined by the Appraisal Qualifications Board. Thus, he should be state licensed as well as certified . Property Law: Activity 16: Case problem 3: In this case the type of easement involved is Easement by necessity. As in this case Carol claims a right of easement over her land for providing access from the public street. In this case Carol has a valid claim because most of the states give landowners who are not connected to a public road the right to apply for granting a private way over connecting lands. Carol will be successful in her claim for right of easement.(Easement and License. Parol License Irrevocable by Execution. Easement by "Estoppel by Deed", 1919) Case Problem 4: In this case Carol can sue David for trespass over her property. As the driveway easement had expired six months ago but David continued to use the driveway. As per law the easement terminates after expiration of the term. On expiration person cannot claim the right to easement. (Orth, J.V. 2006) Activity 17: Judgment lien is a ruling of the court which gives the creditor a right to take possession of the real property of the debtor if the debtor fails to fulfill the obligations of the contract. Judgment lien may be made against individual or business and it allows the creditor to access the business of the debtor. A real property owner should be concerned about it because once the court has determined matter of non payment and validity of the contract the court shall order judgment lien in favor of the creditor to recover the debt. (Wesoloski, E. 2014) the four ways in which an easement can be created are as hereunder: Express easement Implied easement Easement by way of necessity Easement by prescription Easement by necessity is a right where the owner of land has no access to the public road hen he has a right to apply for grant of a private way or a easement over connecting lands. The easement of prescription requires use of land to be open ad undisputed from a specified period of time. Prescription is title by authority of law which derives its force from use of the land and the time.(Calvanico, J.J. 2007) The easement can be terminated by way of merger. An easement is automatically terminated if at any point of time the same person becomes the owner of both the dominant and the servient tenements.(Conard, A.1942) Activity 19: The preparation of real estate contract requires a very careful attention because the purchaser and the seller of the real property both have number of issues and concerns which are required to be addressed. The paralegal who prepares the sale purchase agreement must be aware of all these issues in general and may ask his clients about including any special or specific issue in the agreement. The time of essence clause in a real estate contract means that one party to the contract must perform the obligations of the contract at the date specified in the contract in order to compel the other party to perform their part of the contract.(Stannard, J.E. 2005) When a title is known as a marketable title it means that the history of ownership about that property is clear and there is no dispute or defect regarding the ownership. As a result, they can be marketed without any additional effort. On the other hand the insurable title may have a known defect and it is agreed by an insurance company to provide insurance against such defects.(Spencer Compton, ,S.H. 2003) In most of the real property contracts it is provided about the possession of the property that the purchaser will take possession of the property after the payment of the full and final amount of consideration as agreed in the contract. The closing date is important in the real estate because on this date the ownership of the property transferred to the buyer and the deed is signed over to the buyer. Activity 20: The provisions of the said real estate contract are in favor of the seller as it provides that according to contract seller shall transfer insurable title to the buyer an shall transfer all utility easements an restrictions with it.(Fink, J. 1994) In this case the buyers had the knowledge of the fact that the house they are going to buy is very old and might leak. They should have included this fact in the terms of the contract. The Harold and Maude cannot prove the oral statement as a misstatement. The buyers Harold and Maude cannot succeed in an action against Sam because the agreement expressly says that no warranty which is not expressly included in the agreement shall not be entertained. Activity 21: Practical problem 2: A copy of a contract for sale of residential real estate from a local real estate broker and the one given in Exhibit 7-1 are similar in the sense that both contain the buyer and seller name at the beginning of the contract and then the 2nd and 3rd parts are also similar. Both contain the details of the property in question and the purchase price and mode of payment respectively. However, the next part differs. The exhibit 7-1 contains the information about the types of loan, which is missing in the local contract. Then the details of earnest money are in both, but Exhibit contains a more detailed form of it. Closing, title and possession details are similar. But, the termite letter is missing in the local contract. Details of agency and brokerage is again more detailed in Exhibit. The notices heading is also missing in the local one. Rest all the things are similar in both. Practical problem 4: As mentioned in the 10-12-3 of The Uniform Electronic Transactions Act, adopted by Georgia, which came into effect from 1 July, 2009 (Appendix 1), electronic signatures are recognized on real estate documents (J. Piercy, 2015). However, there are certain limitations to it, as specified by subsection (b) of this section, which is: such signatures are not recognized for a transaction, if it is governed by: (1)A law, which governs the creation and execution of codicils, wills or testamentary trusts (Justia Law, 2015); (2)Title 11 except the Code Sections 11-1-107 and 11-1-206, Article 2, and Article 2A; or (3)The Uniform Computer Information Transactions Act (Lexisnexis.com, 2014). Activity 23: (a) Brokerage commission in this sale is 1% of the purchase price and it will be completely paid by the seller. (b) Wearever Life Assurance Company, will be the holder of the real estate note and the deed to secure debt that is going to be assumed by the purchaser in connection with this transaction. (c) My Town, Great County, State is the name of the property sold in this sale. (d) The seller must obtain 85% of the tenant estoppels. (e) The purchaser is willing to consent to new leases on the property only subject to terms: base rental should be $ 16 per square foot and common area maintenance charges should be $1.75. (f) 54,520 net rentable square feet are contained in this agreement. (g) The closing of this transaction will take place at the offices of Purchasers attorneys, Winkom, Blinkholm and Nodd, 1400 Crabtree Place Tower, My Town, State, or any other such location, which will be mutually agreeable to purchaser as well as seller. (h) The amount of gross rental income from the property, which the seller guarantees are $850,000.00. (i) Quarterly basis. (j) Saturday is not a business day. (k) $75,000.00 (l) The Effective Date shall be the last date on which, either the Purchaser or Seller will have executed this Agreement. (m) Quitclaim deed. (n) At closing. (o) The only remedy which seller will have is that the whole deposit will be paid to him in the form of full liquidated damages. (p) Yes, the purchaser can do so. (q) Yes, if the amount is anything less than $25,000, the purchaser can terminate the agreement. (r) Interest bearing. (s) Ticor Title Insurance Company of California or Chicago. (t) October 1. (u) No. (v) Half by purchaser and half by seller. (w) Shall be terminated and release will be obtained with respect to them. (x) Seller will have till delivery. (y) A credit will be paid to the purchaser for security deposits under lease. Activity 25: (a) Specific performance of contract, (b) rescission, (c) money damages or (d) liquidated damages. Contract with partnerships must be carefully examined so as to determine the actual authority, which the partners have, in case less than the total number of partners negotiate and sign the contract. Moreover, in limited partnerships, the authority of partners is limited. In case of executors, they have only limited power to enter into real estate contracts, which is provided to them by the state law along with the will. So, it is essential to look into the state law as well as the will, to know the actual powers executors have (Americanbar.org, 2015). Similarly, it's important to examine carefully the contracts entered into trustees, because they too have powers limited to the extent provided by the state law and the trust instrument. A real estate broker is entitled to a commission if he gets successful in finding a person who wishes and is capable of purchasing the real estate property at that price an those conditions, which have been provided by the seller in the listing agreement (Grieco, 2015). The remedy of specific performance is the most desirable because this remedy, the party in default is ordered by the court to perform the contract as was agreed and hence the purchaser gets what was initially bargained for in under the contract (Carey, S.A., Guggenheim, D.B. And Soejoto, M.D., 2013). Activity 26: Case problem 1: The money damages is the difference between the contract price and the propertys market value, which is at the time of default. In the given problem, the contract price is: $1,75,000 and the market value is: $190,000. Thus, applying the rule to calculate the money damages, it will be equivalent to: $190,000-$1,75,000= $1,5000. Case problem 4: The rules for the commission of broker imply that a broker earns commission as soon as he presents a person, who fits into the requirements of the listing agreement of the seller. Even if the seller refuses the offer of a purchaser or even if they both go to contract but the contract is not closed due to some reason, the broker is still entitled to a commission (Callahan, D.G., 2006. Hence, in the present case, Honest Broker becomes entitled to a commission as soon as he introduces I.M. Rich to Alice SkinFlint, irrespective of the fact that the deed closed after the expiration of the date specified by SkinFlint in the listing agreement. Activity 27: Practical problem 4: Yes, a broker can become a dual agent, meaning thereby an agent both for the seller and the purchaser in the transaction of the same real estate. A dual agent must disclose to both the buyer and the seller that he is acting as such and should also disclose the probable effects of him acting as a dual agent. He must also obtain a written consent for such relationship from both the parties on a form, as given in Appendix 2.
